Terms of service

These terms are an agreement between AgentivX Solutions, LLC, a Maryland limited liability company (“AgentivX,” “we”), and the organization that subscribes to RealtyOS (“you”). The person who accepts them confirms they can bind that organization. If you have a signed order form with us, it controls where it differs from these terms.

Your workspace owner decides who is invited and what role each person has. You are responsible for activity under your accounts, for keeping sign-in details private, and for removing access when someone leaves. Tell us promptly at info@agentivx.ai if you believe an account has been compromised.

You own the data you and your team put into RealtyOS, including client, lead, listing, transaction, and document information (“Customer Data”). You give us permission to host, process, and transmit Customer Data only as needed to provide and support the service, and as described in our Privacy Policy.

You confirm you have the rights and consents needed to upload Customer Data and to contact the people in it.

Exports and deletion are handled by AgentivX on request; apart from the audit log export, the product does not offer them as self-service yet. While your subscription is active, you can ask us at info@agentivx.ai for a copy of Customer Data, and we will send it in a common format, such as CSV, within 60 days of the request. After your subscription ends, your workspace owner can ask us in writing to delete Customer Data, and we will delete it within 60 days of the request, except for copies in routine backups, which expire on their normal schedule.

RealtyOS uses AI models to draft messages, marketing, summaries, checklists, and recommendations. AI output can be incomplete or wrong. The service is designed so that a person reviews client-facing output before it is sent or published, and you agree to keep that review in place.

RealtyOS does not provide legal, tax, lending, or brokerage advice. Flags for Fair Housing language, buyer agreements, contract deadlines, and compliance are aids for your licensed professionals, not determinations. You are responsible for what your team sends, publishes, and relies on.

You are responsible for complying with the laws, regulations, and rules that apply to your business, including real estate licensing and advertising rules, fair housing laws, rules on calls, texts, and email marketing, privacy laws, MLS and association rules, and requirements for written buyer agreements. You are responsible for registering your texting program (including A2P 10DLC in the United States) and for any messaging provider accounts you connect.

RealtyOS relies on providers such as Vercel, Supabase, Anthropic, OpenAI, Twilio, Resend, and Stripe. When you connect an account you hold with one of them, your use is also subject to that provider's terms. We are not responsible for services we do not control, but we choose providers with care and will tell you about material changes to the ones that process Customer Data.

You will not use RealtyOS to discriminate unlawfully; to send messages to people who have not agreed to receive them; to upload content you do not have the right to use; to misrepresent property facts; to probe, disrupt, or bypass the service's security; to scrape or resell the service; or to break any law. We may remove content or suspend access that violates this section, and we will tell you why when we can.

Fees are set by your plan or order form and are billed in advance through our payment provider. Subscriptions renew automatically for the same term unless cancelled before renewal. A trial ends on the date shown in Settings, and continuing to use RealtyOS after that requires a paid plan. Fees exclude taxes and third-party messaging costs. Except where the law requires otherwise, fees already paid are not refundable for partial periods.

We protect Customer Data with the measures described on our Security page, including organization-level isolation, role-based access, encryption in transit, and an audit log. Each of us will keep the other's non-public information confidential and use it only for this agreement.

You may cancel at any time; cancellation takes effect at the end of the current billing period. We may suspend access for non-payment after notice, or immediately if needed to prevent harm to the service or others. Either of us may end the agreement if the other materially breaches it and does not fix the breach within 30 days of notice.

We will provide the service with reasonable skill and care. Otherwise, the service is provided “as is,” and to the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that AI output will be accurate or that the service will be uninterrupted.

To the extent the law allows, neither of us is liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Each party's total liability under this agreement is limited to the fees you paid in the twelve months before the event giving rise to the claim. These limits do not apply to your payment obligations or to either party's liability that cannot be limited by law.

You will defend and indemnify AgentivX against third-party claims arising from Customer Data, from messages or content your team sent or published, or from your breach of the compliance and acceptable use sections. We will defend and indemnify you against third-party claims that the service, as we provide it, infringes their intellectual property rights.

We may update these terms. If a change is material, we will give at least 30 days' notice by email or in the product before it takes effect. Continuing to use RealtyOS after that date means you accept the updated terms.

These terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. The state and federal courts located in Maryland have exclusive jurisdiction over disputes under these terms.
